  • Comply with all applicable state laws and accept the overhead. This is the conservative path.

  • Bet on federal preemption and build to less restrictive standards. This is risky. If preemption fails, you’re scrambling to retrofit compliance.

  • Geographic restriction. Don’t serve users in heavily regulated states. Feasible for some products, not for others.

Anthropic’s Safety Research: What It Means

Amid the regulatory activity, Anthropic’s alignment science team published research that provides technical context for policy discussions. Their findings are relevant because they indicate where the actual safety risks are.

”Very Low But Not Fully Negligible” Risk

Anthropic’s assessment of risk from deployed models due to emerging misalignment: “very low but not fully negligible” as of Summer 2025. This is carefully hedged language. They’re not saying current models are dangerous. They’re saying the risk isn’t zero.

For developers, this means safety isn’t purely theoretical. There’s a small but real chance that deployed systems could behave in unexpectedly problematic ways. Build with that possibility in mind.

Constitutional Classifiers: Robust But Not Impenetrable
